Abstract in another language
In light of the massive codification movement around the globe in private international law (PIL), this contribution analyses whether there also is a “general part movement”. It takes into account all PIL codifications from the EU member states and the ten most recent (available) PIL codifications from beyond the EU. Based on this data, it concludes that the traditional idea of having general provisions in PIL is not likely to
go out of style any time soon. What is more, there are remarkable parallels as to the content of chapters with general provisions in PIL around the world. More recent codifications, however, often demonstrate innovation in covering more issues than their precursors, occasionally even issues for which no provision exists elsewhere yet. Departingfrom such examples of novelties, the final part of this contribution attempts to find an answer to the difficult question of whether – and if so, where – even more innovation within the “general part” is possible and/or to be expected.
