Das vor allem auf Richtlinien beruhende Arbeitsrecht der Europäischen Union entwickelt sich nicht zuletzt durch die Rechtsprechung des Europäischen Gerichtshofs dynamisch fort. Der Beitrag untersucht, ob das deutsche Arbeitsrecht mit dieser Entwicklung Schritt gehalten hat. Im Ergebnis zeigen sich weitreichende Divergenzen zwischen dem europäischen und dem deutschen Arbeitsrecht. Eine flächendeckende Reform ist notwendig.
Abstract in another language
European Union labour law, which is primarily based on directives, is developing dynamically, not least due to the case law of the European Court of Justice. This article examines whether German labour law has kept pace with this development. The results show far-reaching divergences between European and German labour law. Comprehensive reform is necessary.
