This article examines the legal challenges Ukraine faces in designing domestic cultivation laws and regulation to facilitate trade of genetically modified plants and animals, in particular with a focus on its accession to the European Union (EU). It provides a historic overview of the legal framework governing genetically modified organisms (GMOs) in Ukraine, analyzing current key legislative acts that regulate their use. The article also explores the primary legal obstacles to GMO cultivation and export in Ukraine, in particular lack of proper effective detection and identification of GMOs and regulation of co-existance with conventional and organic goods. Given Ukraine’s strategic role as a trading partner and prospective EU Member State, with a significant share of agricultural exports to the EU, special emphasis is placed on the harmonisation requirement of national legislation with EU law. Recognising the transformative potential of food biotechnology for Ukraine’s economic recovery, this study highlights the urgent need for legal reforms to ensure that GMO regulation fosters innovation and aligns with international and EU standards. Ukraine’s current regulatory framework is marked by weak enforcement, legal inconsistencies, and limited implementation of international norms, underscoring the necessity for comprehensive alignment with EU GMO law.
