Abstract

The proposal amending Directives 2001/18/EC and 2010/53/EU as regards the placing on the market of genetically modified micro-organisms and the processing of organs complements the European Biotech Act by proposing a more targeted, agile, risk-based, and innovation-friendly regulatory
framework for biotechnology. Rather than replacing existing GMO legislation, it proposes to modernise specific rules that are considered disproportionate for genetically modified micro-organisms (GMMs), while maintaining the overarching objectives of protecting human health and the environment.
This briefing is based on the assessment that current EU biotechnology regulation is often fragmented, complex, and insufficiently adapted to scientific and technological progress. The proposal therefore introduces more proportionate regulatory pathways, particularly for low-risk GMMs, through tailored risk assessments, streamlined authorisation procedures, adapted information requirements, and reduced administrative burdens. These measures are intended to accelerate innovation, improve legal certainty, facilitate market access, and strengthen the global competitiveness of the EU biotechnology sector.
The proposal seeks regulatory modernisation based on contemporary scientific knowledge. A comprehensive pre-market risk assessment remains mandatory for all GMMs, including those qualifying for simplified procedures. Safety-related criteria, such as Qualified Presumption of Safety status and the absence of genes of concern, remain scientifically stringent.
The proposal therefore aims to balance innovation and precaution. It aims to maintain a high level of consumer, public health, and environmental protection while introducing more risk-proportionate requirements. The underlying policy assumption is that regulation should focus on the characteristics and risks of products rather than the techniques used to create them. Overall, the reform reflects a broader shift towards enabling biotechnology innovation, investment, and market deployment while preserving core EU safety and environmental safeguards.
