Zentrales Anknüpfungskriterium der EuInsVO 2015 ist der Mittelpunkt der hauptsächlichen Interessen (centre of main interests – COMI) des Schuldners. In seinem Urt. v. 16.7.2020 in der Rs. Novo Banco hat der EuGH diesen Begriff sowie speziell die Bedeutung und Reichweite der Vermutung in Art. 3 Abs. 1 UAbs. 4 EuInsVO 2015 näher konturiert. Der Beitrag analysiert die Entscheidung und ihre Folgen.
