Abstract
The ECJ’s decision in case C-583/18, VBZ Berlin ./. DB Vertrieb, concerns certain distance contracts (about the German “BahnCard") which give the customer a discount for future passenger transport service contracts. The CJEU held that such contracts are service contracts within the meaning of Art. 2
No. 6 of the Consumer Rights Directive, albeit with the rather curt explanation that they are not sales contracts. It further decided that the exception for passenger transport services (Art. 3 (3)(k) of the Directive) does not apply to such contracts, so that consumers generally have a right of withdrawal. While the Court’s reasoning cannot be praised and an opinion by the Advocate General is sorely missed, the result is correct.
