Faced with the ongoing evolution of software agents from mere passive tools to etailers acting autonomously for their human owners (principals), new legal challenges appear on the agenda. One of them is the question, how contracts concluded by software agents should be treated legally. Based on the characteristics of software agents identified from the definition of the term, this paper examines whether and how the conclusion of contracts by software agents is compatible with current legislation or poses problems that need to be addressed in the future. Thereby special focus will be on the autonomy property, as this one is highly disputed in legal terms.

Avec le développement continu d'agents logiciels, qui de simples programmes d'assistance passive ont évolué pour devenir des programmes électroniques agissant de manière autonome, des problèmes et défis juridiques nouveaux sont apparus. Dans ce contexte, la question se pose de savoir comment les contrats conclus par ces agents logiciels doivent être traités légalement. Se basant sur les caractéristiques des agents logiciels selon la définition du terme, cet article examine si et dans quelle mesure, les contrats conclus par ces agents sont compatibles avec la législation actuelle. Dans cet article, l'accent sera mis particulièrement sur la propriété d'autonomie des agents logiciels, ceux-ci étant extrêmement contestés en termes légaux.
